Income tax is a direct tax on taxable income under applicable Indian law. Income can arise from salary, house property, business or profession, capital gains and other sources. Taxable income and the correct return form depend on residential status, the taxpayer's legal status, income classification, exemptions, deductions and special-rate income. Phoenix Tax supports individuals, professionals, businesses, firms, LLPs, companies and eligible trusts with return preparation and tax compliance in Chennai and Tambaram.
The Income-tax Act, 2025 came into force on 1 April 2026. It reorganises the direct-tax law and introduces the concept of a Tax Year for the new framework. Important transition: income earned in FY 2025–26 is reported for AY 2026–27 under the Income-tax Act, 1961, even when the return is filed after 1 April 2026. Income of Tax Year 2026–27 is governed by the new Act. Taxpayers should not mix provisions or section numbers across these periods.
| Taxable Income | New Regime Rate |
|---|---|
| Up to ₹4,00,000 | Nil |
| ₹4,00,001 – ₹8,00,000 | 5% |
| ₹8,00,001 – ₹12,00,000 | 10% |
| ₹12,00,001 – ₹16,00,000 | 15% |
| ₹16,00,001 – ₹20,00,000 | 20% |
| ₹20,00,001 – ₹24,00,000 | 25% |
| Above ₹24,00,000 | 30% |
These are progressive slab rates, not a flat rate on the entire income. Eligible resident individuals may receive rebate under section 87A up to ₹60,000 where total income does not exceed ₹12 lakh, subject to exclusions for certain special-rate income and other conditions. A standard deduction of ₹75,000 may be available for eligible salaried taxpayers under the new regime; therefore, salary up to ₹12.75 lakh may result in nil tax in qualifying cases. Marginal relief and applicable cess/surcharge must also be considered.
| Taxable Income (individual below 60) | Old Regime Rate |
|---|---|
| Up to ₹2,50,000 | Nil |
| ₹2,50,001 – ₹5,00,000 | 5% |
| ₹5,00,001 – ₹10,00,000 | 20% |
| Above ₹10,00,000 | 30% |
Under the old regime, age-based basic exemption limits may differ for eligible senior citizens. Certain deductions and exemptions such as section 80C, eligible health insurance deductions, HRA and housing-loan interest may be claimed subject to statutory conditions. Old-regime rebate provisions differ from the new regime. Health and Education Cess is generally 4% on income tax plus surcharge, where applicable.
| Regime | Advantages | Considerations / Disadvantages |
|---|---|---|
| New Tax Regime | Lower slab rates in many income bands; simplified calculation; higher eligible rebate; reduced reliance on tax-saving investments. | Many popular deductions/exemptions are unavailable; may not be optimal where substantial eligible deductions exist; special-rate income may still be taxable. |
| Old Tax Regime | Can benefit taxpayers with significant eligible deductions and exemptions; allows certain traditional tax-planning benefits. | Higher slab rates in several bands; more documentary proof and claim verification; not always the lower-tax option. |
Professional approach: Compare both regimes after checking salary, HRA, housing loan, insurance, investments, business income, capital gains and any restrictions on changing regimes. Business/profession taxpayers may have additional procedural conditions for opting out of the default regime.
| Section (1961 Act) | Nature of Payment | Indicative TDS Rate |
|---|---|---|
| 192 | Salary | Applicable slab computation |
| 194A | Interest other than securities | 10% |
| 194C | Contractor | 1% / 2% |
| 194H | Commission or brokerage | 2% |
| 194-I | Rent – plant/machinery; land/building | 2% / 10% |
| 194J | Technical services / specified royalty; other professional fees | 2% / 10% |
| 194-IA | Specified immovable property transfer | 1% |
| 194Q | Specified purchase of goods | 0.1% |
| 194T | Specified partner remuneration / interest etc. | 10% |
Important: TDS applicability is subject to payment thresholds, payer/payee status, residency, PAN availability, declarations, lower/nil deduction certificates, exemptions and other provisions. Section 194T generally applies from 1 April 2025, subject to the ₹20,000 annual threshold. These section numbers refer to the 1961 Act and are shown for AY 2026–27; consult the applicable mapping and rules for Tax Year 2026–27 under the 2025 Act.
Tax Deducted at Source is collected by the payer on prescribed payments and credited to the government. A taxpayer should reconcile Form 26AS, AIS/TIS, salary certificates, interest statements and books before filing. Incorrect TDS reporting may delay credit or refund processing. Businesses should check deduction timing, deposit, quarterly statements, TDS certificates and applicable expense-disallowance provisions.
Rectification: Used for a mistake apparent from the record in an eligible intimation/order, subject to the applicable statutory procedure. For assessment years governed by the 1961 Act, section 154 remains relevant.
Revised Return: Corrects omissions or wrong statements in an already filed return, within the applicable time limit. For AY 2026–27, section 139(5) of the 1961 Act applies; the deadline is generally 31 March 2027 or completion of assessment, whichever is earlier, subject to enacted provisions.
Belated Return: If the original due date is missed, eligible taxpayers may file a belated return. For AY 2026–27, the general belated-return deadline is 31 December 2026 or completion of assessment, whichever is earlier; late filing fees and interest may apply.
Updated Return (ITR-U): Permits specified corrections with additional tax, subject to eligibility and statutory time limits. It generally cannot be used to reduce tax liability or increase a refund. Under the new Act, the unified return provisions are in section 263; check the applicable year before selecting the procedure.
Refunds may arise where TDS, TCS, advance tax or self-assessment tax paid exceeds the final liability. Incorrect bank validation, unmatched TDS, AIS differences, missing income or return-processing adjustments can affect refunds. Notices may require document reconciliation, a response on the portal, revised computation or appropriate rectification/appeal depending on the notice type. Do not assume every notice requires the same response.
ITR-1 is for certain eligible individual income profiles; ITR-2 generally covers individuals/HUFs without business income but with other reportable income such as capital gains; ITR-3 generally covers individuals/HUFs with business or professional income; ITR-4 is for eligible presumptive taxation cases; ITR-5 covers many firms/LLPs and specified entities; ITR-6 is generally for companies not claiming section 11 exemption; ITR-7 applies to specified trusts, institutions and other persons under special return provisions. Eligibility, exclusions and notified form instructions must be checked for the relevant year.
PAN, Aadhaar as applicable, bank account details, Form 16, Form 16A, Form 26AS, AIS/TIS, salary/pension records, bank interest, rental income and home-loan certificates, capital gains statements, investment proofs, business books, GST/TDS reconciliation, financial statements, audit reports and foreign asset disclosures where relevant. The exact list depends on the taxpayer and ITR form.
Advantages: statutory compliance, claim of eligible refunds, accurate financial records, documentation useful for financial applications and easier resolution of tax-credit mismatches. Risks of delay or incorrect filing: late fees, interest, restrictions on carrying forward certain losses, delayed refunds, notices and possible penalties where applicable. Filing does not guarantee loan approval or refund approval.

Is income up to ₹12 lakh always tax-free? No. The eligible rebate under the new regime has conditions and does not cover every type of income or taxpayer. Special-rate income and other restrictions may change the result.
Can I switch between tax regimes? Eligibility and procedural restrictions differ, particularly where business or professional income exists. Compare the rules for the relevant year.
Can I revise a return after filing? Yes, subject to the applicable revised-return deadline and eligibility. Rectification and updated return are different procedures.
Does TDS deducted mean no ITR is needed? Not necessarily. Filing requirements depend on total income, taxpayer status and other mandatory-filing provisions.
