Every year our Tambaram, Chennai office gets the same question from salaried people, pensioners and small business owners: “Which tax regime should I choose, and how much can I really save?” This guide answers it with the latest 2026 rules, taken only from the Income Tax Department, CBDT and PIB.
Quick answer: how to save income tax in 2026
How can I save income tax in 2026? For income earned in FY 2025-26 (return filed in 2026, AY 2026-27), a resident individual pays no income tax up to ₹12 lakh of taxable income under the new tax regime, because of the section 87A rebate of up to ₹60,000. A salaried person also gets a ₹75,000 standard deduction, so salary up to ₹12.75 lakh is tax-free. Above that, compare both regimes: the old regime helps only if your deductions (80C, 80D, NPS, HRA, home-loan interest) are large. From 1 April 2026, the new Income-tax Act, 2025 applies, but the slabs, rebate and standard deduction stay the same.
Three things to do now:
- Work out your tax under both regimes before you choose.
- Keep proof for every deduction you claim (old regime).
- File on time – the due date decides whether you can carry forward losses and avoid late fees.
What changed in 2026
New law from 1 April 2026. The Income-tax Act, 2025 (No. 30 of 2025) replaced the Income-tax Act, 1961 from 1 April 2026. The Income-tax Rules, 2026 were notified on 20 March 2026. The government has said the new Act simplifies the language and forms without changing the underlying tax policy.
"Tax year" replaces "previous year" and "assessment year". Under the 2025 Act, Tax Year 2026-27 means income earned from 1 April 2026 to 31 March 2027.
Which law applies to which return:
| Income earned | Law | Return |
|---|---|---|
| 1 Apr 2025 – 31 Mar 2026 (FY 2025-26) | Income-tax Act, 1961 | AY 2026-27, filed in 2026 |
| 1 Apr 2026 – 31 Mar 2027 (Tax Year 2026-27) | Income-tax Act, 2025 | Filed in 2027, in the new forms |

New regime vs old regime: rates for AY 2026-27
The new regime (section 115BAC, now section 202 of the 2025 Act) is the default. If you want the old regime, you must choose it in your return. Salaried people without business income can switch every year; people with business or professional income can switch back to the new regime only once.
New regime slabs (individuals, all ages):
| Taxable income | Rate |
|---|---|
| Up to ₹4,00,000 | Nil |
| ₹4,00,001 – ₹8,00,000 | 5% |
| ₹8,00,001 – ₹12,00,000 | 10% |
| ₹12,00,001 – ₹16,00,000 | 15% |

| ₹20,00,001 – ₹24,00,000 | 25% |
| Above ₹24,00,000 | 30% |
Old regime slabs:
| Taxable income | Below 60 | Senior (60–79) | Super senior (80+) |
|---|---|---|---|
| Up to ₹2,50,000 | Nil | Nil | Nil |
| ₹2,50,001 – ₹3,00,000 | 5% | Nil | Nil |
| ₹3,00,001 – ₹5,00,000 | 5% | 5% | Nil |
| ₹5,00,001 – ₹10,00,000 | 20% | 20% | 20% |
| Above ₹10,00,000 | 30% | 30% | 30% |
Side by side:
| Point | New regime | Old regime |
|---|---|---|
| Section 87A rebate (residents) | Up to ₹60,000 if taxable income ≤ ₹12 lakh | Up to ₹12,500 if taxable income ≤ ₹5 lakh |
| Standard deduction (salary/pension) | ₹75,000 | ₹50,000 |
| Family pension deduction | ₹25,000 or 1/3rd, lower | ₹15,000 or 1/3rd, lower |

| Employer NPS contribution 80CCD(2) | Up to 14% of salary | Up to 10% (14% for Government employers) |
Just above ₹12 lakh, marginal relief applies: the tax payable cannot be more than the income above ₹12 lakh. Surcharge applies above ₹50 lakh (new regime maximum 25%), and 4% health and education cess applies on tax plus surcharge in both regimes.
Old regime: deductions that actually save tax
These apply to FY 2025-26 income under the Income-tax Act, 1961 (new section numbers from Tax Year 2026-27 in brackets).
| Deduction | What qualifies | Limit |
|---|---|---|
| 80C (123) | EPF, PPF, LIC premium, ELSS, 5-year tax-saver FD, NSC, Sukanya Samriddhi, children's tuition fees, home-loan principal | ₹1,50,000 (together with 80CCC and 80CCD(1)) |
| 80CCD(1B) (124) | Your own NPS contribution | Extra ₹50,000 over the 80C limit |
| 80D (126) | Health insurance for self, spouse, children; preventive check-up up to ₹5,000 inside the limit | ₹25,000 (₹50,000 if senior citizen) |
| 80D – parents (126) | Health insurance for parents | Another ₹25,000 (₹50,000 if parents are senior citizens) |
| 24(b) (22) | Interest on home loan for a self-occupied house | ₹2,00,000 |
| 10(13A) | House Rent Allowance (HRA) for rented house | Lowest of actual HRA, rent minus 10% of salary, or 50% of salary in Chennai (metro) |
| 80GG (134) | Rent paid when you get no HRA | Lowest of ₹5,000 a month, 25% of total income, or rent minus 10% of total income |
| 80E (129) | Interest on higher-education loan | Full interest, for up to 8 years |
| 80G (133) | Donations to approved funds and charities | 50% or 100% of the donation; cash above ₹2,000 not allowed |
| 80TTA (153) | Savings bank interest (below 60) | ₹10,000 |
| 80TTB | Deposit interest for senior citizens | ₹50,000 |
| 80DDB (128) | Treatment of specified diseases | ₹40,000 (₹1,00,000 for senior citizens) |
Practical tips:
- EPF deducted from your salary already counts towards 80C. Check it before buying more policies.
- Pay health insurance premium by any mode other than cash (cash is allowed only for the preventive check-up).
- HRA needs rent receipts; give the landlord's PAN if annual rent is above ₹1,00,000.
- If you claim HRA and home-loan interest together, keep proof of why you live in a rented house.
New regime: how to still save tax
The new regime removes most deductions, but these still work:
- Standard deduction of ₹75,000 for salary and pension – automatic.
- Employer's NPS contribution – 80CCD(2): up to 14% of salary (basic + DA). Ask your employer to restructure part of your pay into NPS.
- Home-loan interest on a let-out house – 24(b): allowed against rental income. Any loss cannot be set off against salary or carried forward.
- Agniveer Corpus Fund – 80CCH: contributions are deductible.
- Family pension: ₹25,000 or one-third, whichever is lower.
- Exempt receipts still exempt: gratuity, leave encashment on retirement (within limits), PPF and Sukanya Samriddhi interest and maturity, and life-insurance maturity that meets section 10(10D) conditions.
- Stay under ₹12 lakh taxable income where you can – timing of bonus, or employer NPS, can bring you inside the rebate.
Note: the ₹60,000 rebate does not cover tax on special-rate income such as capital gains under sections 111A and 112A. Plan share sales separately.
Worked examples (resident, below 60, AY 2026-27)
Example 1 – Salary ₹12,75,000
- New regime: ₹12,75,000 − ₹75,000 standard deduction = ₹12,00,000 taxable. Tax on slabs = ₹60,000. Rebate u/s 87A = ₹60,000. Tax payable: Nil.
Example 2 – Salary ₹15,00,000, with normal savings
- New regime: taxable ₹14,25,000. Tax = ₹20,000 + ₹40,000 + ₹33,750 = ₹93,750 + 4% cess = ₹97,500.
- Old regime, with standard deduction ₹50,000 + 80C ₹1,50,000 + 80D ₹25,000 + NPS 80CCD(1B) ₹50,000 + home-loan interest ₹2,00,000 = ₹4,75,000 deductions. Taxable ₹10,25,000. Tax = ₹12,500 + ₹1,00,000 + ₹7,500 = ₹1,20,000 + cess = ₹1,24,800.
- Result: the new regime saves ₹27,300 even with ₹4.75 lakh of deductions.
Example 3 – Same ₹15 lakh salary, plus HRA exemption of ₹1,20,000 (rented house in Chennai)
- Old regime deductions now ₹5,95,000 → taxable ₹9,05,000. Tax = ₹93,500 + cess = ₹97,240.
- New regime stays at ₹97,500. The two are almost equal; the old regime wins only by ₹260.
Example 4 – Marginal relief
- Taxable income ₹12,10,000 (new regime). Slab tax would be ₹61,500, but marginal relief limits it to the income above ₹12 lakh: ₹10,000 + cess.
Lesson: in the new regime, the break-even point is high. Unless your deductions cross roughly ₹5–6 lakh at this income level, the new regime usually costs less. Always calculate both before filing.

10 frequently asked questions
1. Is income up to ₹12 lakh really tax-free in 2026? Yes, for a resident individual under the new regime. Tax on ₹12 lakh is ₹60,000, and the section 87A rebate of up to ₹60,000 cancels it. For salaried people the limit is effectively ₹12.75 lakh after the ₹75,000 standard deduction. The rebate does not cover special-rate income like capital gains on shares.
2. Which regime applies if I do nothing? The new regime. It is the default; you must opt for the old regime in your return (or, for business income, by filing Form 10-IEA before the due date).
3. Can I change my regime every year? Salaried and pension earners without business income can choose each year at the time of filing. With business or professional income, you can opt out of the new regime and come back to it only once.
4. Did the Income-tax Act, 2025 change my tax rates? No. It applies from 1 April 2026 and renumbers the sections (for example, 80C is now section 123 and 87A is section 156), but the slabs, rebate and standard deduction carry on unchanged.
5. My return for FY 2025-26 – old Act or new Act? Old Act. Income earned up to 31 March 2026 is filed for AY 2026-27 under the Income-tax Act, 1961, in the old forms. Income from 1 April 2026 is filed in 2027 under the 2025 Act.
6. Can I claim 80C or 80D under the new regime? No. Only a few deductions are allowed: standard deduction, employer NPS under 80CCD(2), let-out property interest under 24(b), Agniveer Corpus Fund under 80CCH, and family pension deduction.
7. I missed the 31 July deadline. What now? File a belated return under section 139(4) by 31 December 2026, with a late fee of ₹1,000 (income up to ₹5 lakh) or ₹5,000. You lose the right to carry forward most losses.
8. Is the audit-case due date extended this year? Yes. CBDT Circular No. 07/2026 extended the ITR due date for audit cases to 21 November 2026 and the tax audit report date to 21 October 2026.
9. Should I pay advance tax? Yes, if your tax for the year after TDS is ₹10,000 or more. The next instalment (75% cumulative) is due on 15 December 2026. Missing it attracts interest under sections 234B and 234C.
10. Can Phoenix Tax Consultant compare both regimes for me? Yes. Our Tambaram, Chennai team calculates your tax under both regimes with your Form 16 and AIS, tells you which saves more, and handles your ITR filing in Tambaram, Chennai. Call 9940349819 or WhatsApp us.
